GENERAL TERMS AND CONDITIONS AMPFLOW ENERGY
Version 13 October 2026, English translation
Article 1. Who we are and applicability
1. Ampflow Energy is a trade name of BBJL B.V.. Contact details: info@demo.af.ondaylit.nl, Cuijk.
2. The Chamber of Commerce (KvK) number and VAT number are at the bottom of every page of ampflowenergy.nl.
3. These terms apply to all offers and purchase agreements of Ampflow Energy. Provisions that deviate from mandatory consumer law do not apply to a consumer.
4. If a provision is void or is annulled, the other provisions remain in force.
Article 2. Prices and VAT pre-financing arrangement (Deed of Assignment)
1. The purchase price of a product includes 21% VAT. A consumer can settle the VAT part of the purchase price by digitally signing the Deed of Assignment (Akte van Cessie) at checkout. At checkout they then pay the amount excluding VAT. Before and during checkout the buyer sees the price including VAT, the VAT amount and the amount they pay directly.
2. With the Deed of Assignment the buyer assigns their claim to a refund of the VAT on the order to Ampflow Energy, in settlement of the VAT part. The buyer’s debt for the VAT part is only discharged if and insofar as Ampflow Energy has actually received the refund.
3. The buyer cooperates with notifying the Dutch Tax Administration of the assignment, with their registration as a VAT entrepreneur and with the return(s), and provides the requested details and authorisations within 7 days. If the buyer receives the refund themselves, or the Tax Administration offsets it against a debt of the buyer, the buyer pays that amount to Ampflow Energy within 5 working days.
4. If Ampflow Energy has not received the VAT part in full within 6 months of delivery, for whatever reason, the buyer pays the missing part directly to Ampflow Energy within 14 days of a written request. Anything Ampflow Energy subsequently receives twice, it refunds within 14 days.
5. Products in the Installation material category (such as the preparation kit for a heat pump) fall outside this arrangement: the stated price including 21% VAT applies and no Deed of Assignment is signed. If the buyer orders both installation material and other products, the Deed of Assignment only applies to the other products and the shipping costs.
6. The full arrangement is set out in the Deed of Assignment. The buyer receives a copy with the order confirmation. In case of conflict, the deed prevails.
7. Obvious errors in prices or product information do not bind Ampflow Energy. Ampflow Energy reports such an error as soon as possible; the buyer can then dissolve the purchase free of charge.
Article 3. Conclusion of the agreement and payment
1. The purchase agreement is concluded as soon as the buyer has completed the order and payment has succeeded. Ampflow Energy confirms the order by email.
2. Payment is made via the payment methods offered at checkout.
3. Delivered products remain the property of Ampflow Energy until the buyer has paid everything owed under the purchase, including the VAT part. The VAT part only counts as paid when Ampflow Energy has received the refund or the buyer has paid the amount themselves.
4. If the buyer is in default of payment, after a reminder with a 14-day payment period they owe statutory interest and extrajudicial collection costs in accordance with the statutory rules.
Article 4. Delivery
1. Ampflow Energy delivers as soon as possible and no later than within 30 days, unless a different delivery time has been agreed. If that is not possible, Ampflow Energy reports it; the buyer can then dissolve the purchase free of charge and receives the amount paid back within 14 days.
2. The risk of loss or damage passes to the buyer as soon as they or a person designated by them has received the product.
Article 5. Right of withdrawal
1. A consumer can withdraw from the purchase within 14 days of receiving the product without giving reasons. For an order with several products delivered separately, the period starts after receipt of the last product.
2. Withdrawal is possible by email or with the model form on the withdrawal page. The buyer then returns the product within 14 days. The direct costs of returning are for the buyer; for large or heavy products such as battery modules these can be high.
3. During the cooling-off period the buyer handles the product with care and only unpacks and uses it as far as necessary to establish its nature and functioning. A product that has been installed and put into use may have lost value; Ampflow Energy may deduct that loss of value.
4. Ampflow Energy refunds the purchase amount, including the standard shipping costs, within 14 days of the withdrawal. Ampflow Energy may wait until the product has been received or the buyer shows that it has been returned.
5. On withdrawal, the Deed of Assignment for that product also lapses. A refund Ampflow Energy has already received for that product is offset or repaid to the Tax Administration (article 9 of the deed).
Article 6. Conformity and warranty
1. Products comply with the agreement and with the requirements that may be set for normal use. A consumer’s statutory rights always continue to apply.
2. A manufacturer’s warranty applies in addition to, not instead of, the statutory rights.
3. Defects caused by incorrect installation, improper use, use contrary to the manufacturer’s instructions, or modifications by the buyer or third parties are not covered by the warranty.
Article 7. Liability
1. Ampflow Energy’s liability is limited to the amount its liability insurance pays out in the case concerned, and otherwise to the purchase price of the product concerned.
2. Ampflow Energy is not liable for indirect damage, such as consequential damage, lost profit or missed savings, nor for damage caused by installation or use contrary to the manufacturer’s instructions.
3. These limitations do not apply in the event of intent or deliberate recklessness, nor to product liability under the law, nor insofar as mandatory law prohibits them.
Article 8. Complaints
1. The buyer reports complaints within a reasonable time after discovering a defect, by email, with a clear description and photos where possible.
2. Ampflow Energy responds in substance within 14 days, or lets the buyer know within that period when a substantive response will follow.
Article 9. Personal data
1. Ampflow Energy only uses personal data to handle the order, the delivery, the Deed of Assignment and the VAT refund and to comply with legal obligations, in accordance with the GDPR. Payments are processed via Mollie.
More about this is in the privacy statement.
Article 10. Applicable law and disputes
1. Dutch law applies to all agreements with Ampflow Energy.
2. Disputes with a consumer are submitted to the court that has jurisdiction by law. Disputes with a business buyer are submitted to the competent court in the district where Ampflow Energy is established.
